M&M Guatemala Newsletter – New Measures COVID

Last week, the Official Bulletin published Ministerial Accord 158-2022 of the Ministry of Health and Social Assistance, as well as Accord 159-2022 of the same authority, which amends it. 

They establish the new regulation for the Health Alerts System in response to the COVID-19 pandemic, repealing various provisions in effect since 2020 and 2021. As has been the case, a health alert chart will be published every fifteen days, determining the level of alert for each municipality. The measures to be observed will depend on the alert color. 

The main health provisions established are:

1.   Mandatory hand hygiene with soap and water, or with liquid or gel alcohol at a minimum concentration of 70%.

2.   Physical distancing between persons of at least 1.5 meters. This is mandatory in open and closed spaces on red alert. It is recommended in closed spaces on orange alert. It is not applicable on yellow and green alerts.

4.   Use of face covering or mask. It is mandatory in open and closed spaces on red alert. On orange and yellow alerts, it is recommended in closed spaces. In any case, children under 2 and persons with medical counterindications are excluded from the rule. It is also excluded on green alert. 

Local authorities (municipalities), public and private entities, are authorized to increase such provisions. This implies, for example, that some public entity could still require face coverings for entry into their installations (such as registries, ministries, hospitals, or other State offices). It also implies that private entities may still require the use of face coverings for their employees and customers, within their respective installations and workplaces. In no case may such authorities or entities diminish the general provisions set by the Ministry of Health.
