In accordance with Article 61.h) of the Guatemalan Labor Code, employers must grant employees the necessary time for voting in popular elections, without reducing their salary.
If your company will not cease activities on Sunday August 20th, 2023, date of the presidential runoff election, it must make all personnel arrangements to comply with this obligation. Failure to comply could be invoked by employees as cause of indirect dismissal and sanctioned as a labor offense by administrative authorities.
Likewise, the Electoral and Political Parties Act (Articles 175 and 184) requires employers to grant their employees the necessary permissions, with salary and benefits, to serve on electoral boards and vote reception boards.
